A bill has been filed in the House of Representatives seeking to impose the death penalty by firing squad for public officials convicted of corruption, malversation of public funds, and plunder. 

House Bill No. 11211, also known as the Death Penalty for Corruption Act, was introduced by Zamboanga del Norte 1st District Representative Khymer Adan Olaso, aiming to address systemic corruption in the country.

The measure specifically targets public officials at all levels, from barangay officials to the president, as well as members of the military and police forces. 

If enacted, the bill would apply to individuals convicted of graft under Republic Act No. 3019, malversation under the Revised Penal Code, and plunder under Republic Act No. 7080.

“The bill emphasizes accountability and deterrence, making it clear that public office is a public trust, and any violation of that trust must be met with the severest consequences,” Olaso stated.

Under the measure, the imposition of the death penalty would only occur after the Supreme Court affirms the conviction and all legal remedies, including appeals and motions for reconsideration, are exhausted. 

HB 11211 also provides for an automatic review of convictions, ensuring due process is upheld.

The bill specifies that officials from all branches of government, constitutional commissions, government-owned and controlled corporations, and other public instrumentalities would be covered under its provisions.

While the 1987 Constitution generally prohibits capital punishment, Congress is authorized to reinstate it for heinous crimes. 

The proponent of the bill believes that bringing back the death penalty for corruption will send a strong message of zero tolerance for abuse of power.

“By passing this legislation, Congress sends a strong message that integrity and accountability are paramount in public service and that the misuse of public resources will not be tolerated,” he said.
