New rules governing barangay and Sangguniang Kabataan (SK) elections implement a shift to four-year terms and reset the next polls to November 2026.
The Commission on Elections (COMELEC), through Resolution No. 11207 promulgated on March 17, 2026, released the implementing rules and regulations (IRR) of Republic Act No. 12232, which extends the term of office of barangay and SK officials and adjusts the election cycle.
This follows a Supreme Court (SC) ruling upholding RA 12232 and affirming Congress’ authority to set barangay officials’ terms, treating the law as primarily a term-setting measure.
The decision contrasts with a 2023 SC ruling that struck down a similar postponement of barangay elections, where the Court stressed that any delay must be justified by “sufficiently important, substantial, or compelling reasons” to safeguard the right of suffrage.
Under the IRR, COMELEC states that the term of office for all elected barangay and SK officials shall be four years, with elections to be held on the first Monday of November 2026 and every four years thereafter, and elected officials assuming office on December 1 following the polls.
It further provides that barangay officials may serve no more than three consecutive terms in the same position, while SK officials are limited to one term.
The rules also clarify that voluntary renunciation “shall not be considered as an interruption in the continuity of service for the full term” of an elected official.
Meanwhile, the IRR provides that incumbent barangay and SK officials shall remain in office in a holdover capacity until their successors are elected and qualified, unless sooner removed or suspended for cause.
The IRR also states that barangay officials already serving a third consecutive term in the same position are disqualified from seeking reelection to the same post in the 2026 elections, based on official COMELEC records of proclamation and assumption of office.
However, the IRR clarifies that this restriction does not apply to SK officials, allowing those elected in October 2023 to seek reelection in 2026, provided they meet all qualifications and are not otherwise disqualified at the time of filing their certificates of candidacy.
RA 12232, signed in August 2025, postponed the December 2025 Barangay and SK Elections and extended officials’ terms from three to four years.
The IRR takes effect immediately upon publication, with COMELEC directed to ensure its dissemination in newspapers of general circulation.
