
The government has unveiled the guidelines to ensure the effective implementation of Republic Act No. 12021, the Magna Carta of Filipino Seafarers Act, which was signed into law in September 2024.
President Ferdinand Marcos Jr. signed on January 6 the implementing rules and regulations (IRR) for RA 12021, a law aimed at improving the working conditions and benefits for Filipino seafarers.
The president emphasized the importance of the IRR in safeguarding the rights and welfare of seafarers, stating that these provisions are critical in ensuring fair treatment and enhancing the future prospects of maritime workers.
“These efforts are part of a holistic framework designed to uplift the lives of Filipino seafarers and their families, securing their future in a rapidly evolving industry,” the president stated.
The IRR outlines 22 key provisions that strengthen seafarers’ rights, including safe travel, access to legal representation, and protection against discrimination and harassment. It also mandates that employers ensure fair working conditions, such as adequate rest periods, medical care, and coverage for repatriation costs.
Among the provisions is the codification of the seafarers’ right to vote in national elections and the establishment of a welfare fund for distressed seafarers.
“Beyond compliance with international standards, these provisions will secure our seafarers’ rightful place as key contributors to the maritime industry,” Maritime Industry Authority Administrator Sonia Malaluan noted.
“This IRR is not merely a procedural step but a promise to protect and empower Filipino seafarers,” she added.
The law also includes measures to promote gender equality within the maritime industry, requiring employers to implement policies supporting equal career opportunities and appropriate working and living conditions for female seafarers.
Marcos called on various agencies, including the Department of Transportation, the Department of Labor and Employment, and the Department of Migrant Workers, to ensure the immediate implementation of all related guidelines.
“We must guarantee that seafarers maximize the benefits provided by this law,” he emphasized.
